Insurance and Reinsurance Arbitration Arising from Disavowal of Various Banking Facilities
Chadbourne represented London market insurers and reinsurers of two large international banking groups in an arbitration in connection with their losses arising from disavowal of various banking facilities accorded to a major Middle East trading group based on the alleged forgery of facility and security documents. The losses claimed against insurers totalled over US$200 million.
Chadbourne Advises on AES Corporation's Sale of Three Cameroon Businesses
Chadbourne represented The AES Corporation (AES), a global power company, in connection with the sale of its entire interest in three businesses in Cameroon to UK-based emerging markets investor Actis for US$202 million. The transaction included the sale of a 56 percent equity interest in Société Nationale d’Electricité, Cameroon’s integrated electricity utility, and in two independent power plants: Kribi, a 216 MW gas-fired power plant, and Dibamba, an 86 MW heavy fuel oil-fired plant, in Cameroon.
Chadbourne advised on all aspects of the transaction, fielding a joint corporate and project finance team with French language capabilities and significant experience in the power sector and in francophone Africa.

Chadbourne represented the winning bidder in the development and financing of the 200 MW solar wind park in the Emirate of Dubai.
British High Court Challenge to Football League Rules and Regulations
Chadbourne lawyers successfully defended The Football League in the British High Court in the latest attempt to challenge the legality of the so called "football creditor rule" operated by The Football League. This high profile case was heard at a five-day trial.
The Football League's rules seek to ensure that in the event of a Football League member club becoming insolvent it does not gain an unfair competitive advantage by leaving football-related payments unpaid while continuing in The League. Those creditors required to be paid in full- football creditors- include the member club's employees, other clubs, and The Football League itself.
This decision is a great outcome for The Football League; this critical judgment was widely awaited by the football community in England, and will bring legal certainty to provisions that have been questioned almost from their introduction. The decision also provides clarity on a number of important legal principles of bankruptcy law unconnected with football and of wider importance.
