Chadbourne’s Reputation Protection and Defamation Litigation group protects companies, brands and individuals from unfair reputational attacks that present an increasing threat in the competitive 24/7 information environment. Our seasoned lawyers know how to navigate the complexities of First Amendment law and raise the risk for publishing false and misleading information. We provide pre-publication counseling to stop damaging inaccuracies from being published in the first place by the media, competitors and government. Some of our greatest successes are the stories that never ran. When damaging misinformation is published, we swiftly advocate for truth to correct the record, obtain a retraction or initiate litigation to rectify the wrong. Our lawyers have a strong track record successfully trying defamation, product disparagement, unfair trade practices and First Amendment cases in trial, appellate and administrative courts.
We work closely with our clients to manage media crises arising from investigations, high profile news stories, online reports, litigation and government enforcement proceedings. To prevent undue governmental or agency concern arising from damaging misinformation, Chadbourne lawyers offer problem-solving strategies to provide Congressional members, agency officials and other stakeholders with accurate information.
New Jersey Mayoral Campaign Success
Chadbourne represented Steven M. Fulop during his campaign for mayor of Jersey City, New Jersey, refuting and preventing from publication a sensational false story that threatened to derail Mr. Fulop’s campaign. Not only did the story never run, but the news outlet ultimately endorsed Mr. Fulop for mayor. Mr. Fulop went on to defeat the heavily favored incumbent in the election.
Successful Defamation Action on Behalf of Law Firm
Chadbourne represented a prominent New Jersey law firm in a defamation action brought when defendants disseminated a false and defamatory political campaign flyer. When the defendants would not take action to correct the situation, Chadbourne filed a complaint for defamation. Within days after the complaint was filed, the defendants mass-mailed a remedial flyer with a retraction and apology, thus resolving the matter.
Resolved Issue for Prominent New Jersey Lawyer
Chadbourne represented a prominent New Jersey lawyer who was falsely accused of improper conduct in the front section of a newspaper and online. Chadbourne sent a cease and desist notice and demand for retraction. The news outlet published a prompt retraction and apology, featured prominently in the first section of the print publication as well as online.
