Tchenguiz & Ors v. The Director of the Serious Fraud Office
Chadbourne represented Stephen Akers and Mark McDonald, Joint Liquidators of Oscatello Investments Limited and three other BVI Companies formerly in the control of the Tchenguiz Brothers, as Respondents in proceedings brought by the Tchenguiz Brothers against the SFO in relation to reports prepared and allegedly used in their arrest and dawn raids made on their companies. The issues which arose related to disclosure and use of documents prepared as part of the liquidation and remains a high profile matter as, although the original litigation has settled, the ongoing arguments regarding the use of the documents have wider-reaching consequences, e.g. in Guernsey where actions continue. Chadbourne recently assisted with defeating an application made by the Tchenguiz brothers and successfully argued that the clients should be entitled to indemnity costs.
