Practice Description
Sylwester Pieckowski heads the Warsaw office's litigation and ADR practice. His practice focuses on business dispute resolution through negotiation, mediation and arbitration. He has broad international business related experience based on more than 20 years of practice in Polish foreign trade, gained when counseling for PHZ Pezetel, and U.S. corporate and business law, when serving as Chief Legal Officer for Melex USA, Inc. Mr. Pieckowski also practices in international public law and trade law, aviation law, products liability, commercial arbitration and alternative business dispute resolution as well as Polish civil and business law.
Representative Matters
- Represented the defendant in a U.S. antidumping investigation and antitrust litigation against Polish made Melex golf cars (1983-1996).
- Represented Polish aviation companies as defendants in U.S. products liability lawsuits resulting from plane crashes and incidents (M-18 Dromader, PZL-3S engines, M-26 Iskierka, PZL-104 WILGA) (1983-1996).
- Acted as the Polish negotiator of technology transfer and license agreements with Canadian aircraft and aircraft engine manufacturers.
- Represented a major Polish car producer in products liability negotiation and settlement with a German supplier.
- Advised the Polish government in the privatization of PZU (2001).
- Represented a German/Swedish consortium in the privatization negotiations of three Polish spirit companies (2000-2001).
- Represented a Swedish spirit company in a privatization and acquisition of Polmos company (2002-2003).
- Represented a large packaged foods company as defendant in an arbitration with a contractor (2000).
- Represented a Polish communications company as defendant and cross-plaintiff in a major arbitration dispute with a global telecommunications operator (2001-2003).
- Acted as lead negotiator and counsel for a Polish government-owned hotel company in a long term international franchise agreement with a global U.S. firm (2005-2006).
- Acted as lead counsel for a Polish spirit manufacturer as defendant in arbitration and litigation with a Polish competitor and U.S. vodka distributor. Successfully argued the case before the Supreme Court (2001-2006).
- Acted as lead counsel for a U.S. company seeking enforcement of the New Jersey court judgment in Poland. Successfully argued the case before the Supreme Court (2003-2008).
