Practice Description

Mr. Stenger represents clients before the Federal Communications Commission and handles transactions and administrative and court litigation involving FCC-regulated businesses. He has extensive experience in all areas of FCC practice and has successfully represented many investors and service providers in obtaining valuable FCC authorizations and interests in media, wireless, telecommunications, and international properties.

He also regularly handles a wide variety of business transactions for these clients and represents large scale users of telecommunications services such as information service providers. Mr. Stenger has successfully represented clients in FCC rulemakings, administrative and enforcement proceedings, private court litigation, and appeals of administrative decisions.

Representative Matters

Mr. Stenger regularly handles matters for a variety of clients, including:

  • Investors, including investment banks, fund managers, and private investors in structuring their investments in a wide variety of FCC-regulated businesses.
  • Radio and television broadcasters in many purchases and sales of stations and in complying with evolving FCC rules, including HDTV and HD radio.
  • Wireless broadband, PCS, and cellular companies in FCC license acquisitions, including wireless spectrum auctions, assignments and transfers of control, regulatory issues such as E911 and CPNI, and interconnection agreements.
  • Domestic and international telecommunications companies in transactions, including acquisitions and divestitures; Section 214 and State certification proceedings; and FCC and State compliance, including Universal Service Fund, regulatory fees, and access charges.
  • International carriers, including submarine cable and satellite operators with regard to international 214 authorizations, cable landing licenses, satellite licensing, FCC reporting requirements and regulatory fees, and negotiation of service agreements.
  • Broadband and Internet access providers in negotiation of service level agreements for private network and VPN services, peering agreements and Internet numbering body issues, and federal and state regulatory forbearance and service classification issues.
  • Information service providers, teleconferencing companies and other large scale users of telecommunications services in negotiation of service agreements, applicability of USF fees, and regulatory classification issues for wireless broadband and interconnected VoIP services.
  • Non-commercial, educational license holders in broadcasting and educational broadband service licensing, regulatory compliance, and transactions, including spectrum leasing.
  • Building and community owners and managers in regulatory proceedings and business transactions involving service agreements and access to wiring and rights of way.
  • Utilities in wireless licensing, broadband over power line, provisioning of telecommunications services, and FCC mediation of pole attachment rights.
  • Equipment manufacturers with FCC certification and verification applications, FCC compliance, and enforcement proceedings.
