Representative Matters

• Represents domestic and international manufacturers in products liability and consumer protection matters in various federal and state courts, including class action litigation.
• Successfully defended manufacturers in products liability trials nationwide and was part of the Chadbourne team that won major jury verdicts for product manufacturers at trials in Beaumont, Texas; Brooklyn, New York; Philadelphia, Pennsylvania; and Long Island, New York.
• Argued and obtained summary judgment and pre-trial dismissals in various litigation matters. Mr. Falcone argued and prevailed in an interlocutory appeal that resulted in the dismissal of plaintiffs’ fraud and conspiracy claims, which were the significant portions of plaintiffs’ case.
• On behalf of an international manufacturer and affiliated holding company, successfully opposed transfer and consolidation of pending class action litigation into multi-district litigation (MDL) proceedings.
• Currently represents holding companies of product manufacturers when those corporate parents are defendants in products liability actions. Mr. Falcone has successfully employed motion practice, often focusing on the absence of personal jurisdiction and the legal and factual distinctions between the holding company and its manufacturing subsidiary, to obtain pre-trial dismissals for various holding companies. He has also prepared the trial defense for holding companies in products liability/consumer protection cases.
• Counsels international manufacturers with respect to products liability defense, regulatory and risk management issues.
