Practice Description

Igor Muszyński heads the energy and climate change practice at the firm's Warsaw office. He is also an international expert in energy regulatory issues. He has advised Polish and foreign energy companies, local governments and customers of electric energy and fuels. Mr. Muszyński also specializes in project finance and privatizations of energy companies and advises both the State Treasury and the investors. He assisted in the establishment of the first power exchange in central and eastern Europe. Igor Muszyński was directly involved as an expert of the Ministry of Industry and Trade in the process of restructuring and liberalization of the Polish energy market, and advised on conforming of the Polish law to the EU standards while drafting the Energy Law enacted in 1997. He played an instrumental role in the development of the Warsaw Commodity and Power Exchange. Mr. Muszyński has successfully represented a number of energy companies in cases brought before the President of the Energy Regulatory Authority (including cases involving tariffs), the President of the Office of Competition and Consumer Protection, the Court of Competition and Consumer Protection and the Supreme Court, as well as in various disputes, court and mediation proceedings regarding the energy sector. He also represents clients before the European Commission in connection with illegal public aid matters.

Representative Matters

  • In the past 2 years he has advised on a whole variety of issues connected with a total of over 60 wind farms of total capacity exceeding 2900MW.
  • Advises Vattenfall Sales Poland and RWE Polska in a case connected with freeing energy prices in Poland.
  • Advised on financing of a number of infrastructure projects, including advising the Pątnów-Adamów-Konin Power Plant on financing of their 460MW lignite-fired power generating facility.
  • Advised Polskie Górnictwo Naftowe i Gazownictwo S.A. (Polish Oil and Gas Company) in connection with the planned development of the first in Poland liquefied natural gas (LNG) import terminal.
  • Represented a number of Polish power generating utilities and combined heat and power plants (CHPs) in negotiations of long-term electric energy and fuels purchase agreements. 
  • Advised the Ministry of State Treasury and investors participating in the majority of privatization projects in the energy sector.

Mr. Muszyński was listed in Chambers Global – The World’s Leading Lawyers for Business for projects and energy (2007-2009) as well as for energy and natural resources in Poland (2003-2008). He was also listed in Chambers Europe - Europe's Leading Lawyers for Business (2008, 2009) for projects in central and eastern Europe and energy and natural resources in Poland. Mr. Muszyński is recognized by Best Lawyers (2010) for his work in energy and natural resources in Poland.
