Practice Description
Donald Strauber has more than 40 years of experience in complex commercial litigation throughout the United States. He has worked primarily in three areas: health-related litigation, federal securities litigation and shareholder derivative suits. He is co-national counsel for the Purdue defendants in the OxyContin® litigation and is in charge of Jim Beam’s defense of alcohol-health cases. He has also participated in the defense of numerous tobacco cases for The American Tobacco Company.
Representative Matters
- Representing The Purdue companies in the defense of the OxyContin® litigation.
- Represented Jim Beam in connection with Thorp v. Beam relating to the issue of whether a distiller is responsible for a child’s alleged "fetal alcohol syndrome.” The successful defense of this case in Seattle resulted in the voluntary dismissal of similar cases and put an end to the feared onslaught of litigation on that issue.
- Represented Rockwell Automation, Inc. (formerly Rockwell International Corporation) in connection with Broad v. Rockwell, a securities class action on behalf of holders of Collins convertible debentures, arising out of the Rockwell-Collins merger, which was successfully tried in Dallas and affirmed en banc by the Fifth Circuit Court of Appeals.
- Represented Rockwell Automation, Inc. in connection with Billard v. Rockwell, a class action on behalf of the owners of Collins common stock, also arising out of the Rockwell-Collins merger. That action was dismissed by the Second Circuit Court of Appeals.
- Represented Rockwell Automation, Inc. in the defense of litigation arising out of defective subway cars.
- Represented Swiss Enterprise Corporation of Delaware in connection with Swiss Enterprise Corporation v. Ezrine, a securities fraud action, which Mr. Strauber won before Judge Inzer Wyatt in federal court in New York.

Mr. Strauber is cited in the 2010 edition of SuperLawyers in the specialty of personal injury defense: products.The Legal 500 US (2008) has stated that Donald Strauber is described by clients as “absolutely, absolutely wonderful” and “the dean of the bar for US alcohol liability matters.”
