Practice Description
Cassandre Charles' practice focuses on litigation, with a particular focus on the defense of products liability lawsuits. She handles pre-trial, trial and appellate litigation for domestic and international manufacturers in products liability matters in various state and federal courts and foreign tribunals. Additionally, Ms. Charles is active in Chadbourne’s pro bono program and is a member of the Firm's Recruiting and Diversity Committees.
Representative Matters
- Participated as a member of a trial team representing an English company during a three-month trial in state court in Missouri and secured a defense verdict (2011).
- Obtained summary judgment dismissing all of plaintiff's claims against several manufacturers in a products liability lawsuit filed in New York state court (2011).
- Successfully represented a manufacturer in an appeal to the New York Court of Appeals (the state's highest court), in which the Court reversed a jury verdict in the plaintiffs' favor and dismissed the plaintiffs' claim for defective design.
- Successfully prosecuted an appeal to New York’s Second Department Appellate Division from a Brooklyn jury verdict on behalf of several product manufacturers and trade associations, securing a new trial based on constitutional errors committed during the punitive damages phase of the original trial.
- Obtained affirmance from New York's Third Department Appellate Division of summary judgment dismissal of plaintiff's claims against several manufacturers in a products liability lawsuit, and successfully defended against plaintiff's leave to appeal to the New York Court of Appeals.
- Currently assisting Nigerian counsel in the defense of several lawsuits brought by Nigerian states seeking billions of dollars in recovery of health care expenses.
- Drafted and argued a pro bono criminal appeal in New York's First Department Appellate Division (arson).
- On a pro bono basis, represented Brooklyn homeowners in litigation involving predatory lending, negotiating a favorable settlement.
- Successfully prosecuted a pro bono asylum appeal before the U.S. Department of Justice, Executive Office for Immigration Review, Board of Immigration Appeals.
