EACC Conference on International Arbitration

December 3, 2008

Transatlantic Disputes:
Is Arbitration an Effective Alternative to U.S. Courts for Europeans?

Thursday, December 4th 2008
8:00 AM − 10:30 AM

Chadbourne & Parke LLP
30 Rockefeller Plaza, New York, NY
Boardroom, 36th floor

Program:
8:00 – 8:30: Registration and Networking Breakfast
8:30 – 10:00: Moderated Panel
10:00 – 10:30: Questions & Answers

About the Event:
The U.S. legal system and the risk of getting involved in litigation has been a deterrent for foreign – in
particular European – companies from doing business in the US. The panel will discuss to what extent
international arbitration is a viable (perhaps preferred) remedy and will address the issue from
different perspectives: the client/in-house counsel, the outside counsel, the dispute resolution/forensic
support team, the court, the policy maker, etc.

Panel:

  • Oliver J. Armas, Partner, Chadbourne & Parke LLP
  • Louis Epstein, Vice President and Deputy General Counsel, Transammonia, Inc.
  • Hon. James T. Giles, former U.S. District Judge, Of Counsel, Pepper Hamilton LLP
  • Jeffrey Seymour, Principal, Deloitte Financial Advisory Services LLP
  • Josefa Sicard-Mirabal, Director, Arbitration and ADR, N.A., ICC International Court of Arbitration

Moderated by
:
Jim Rosener, Pepper Hamilton LLP

Topics Discussed:

  • Myths and realities of litigation vs. arbitration: What is faster, what is cheaper, what is better?
  • Concerns of a European party (I): Do I stand a chance at all in US litigation? Can it be
    advantageous for me?
  • Concerns of a European party (II): Class Actions, Punitive Damages, etc. – Are the horror stories
    true?
  • The D-words: Discovery, Disclosure, Depositions, Document Requests: Is it as bad as they say? Is
    arbitration the solution?
  • How do I start my business in the US without getting sued?
  • The financial and economic crises: will that increase the amount of litigation?
